Woman found guilty of involuntary manslaughter because of her text messages

Michelle Carter listens to defense attorney Joseph P. Cataldo argue for an involuntary manslaughter charge against her to be dismissed at Juvenile Court in New Bedford Mass. Carter is charged with involuntary mans

FILE - In this Monday, June 12, 2017 file photo, Michelle Carter stands as court is in recess at the end of the day at her trial in Taunton, Mass. Carter is charged with involuntary manslaughter for encouraging Conrad Roy III to kill himself in July 2014.

Prosecutors said Carter also told Mr Roy to "get back in" when he got out of his truck. When asked how she would describe what Carter did, Lynn was unable to find the words, saying, "I can not". Moniz declared that both Carter's failure to act and her actions amounted to "reckless conduct".

The prosecution claimed Carter, then 17, was reckless and caused his death by telling Roy to get back in the auto even though they say he didn't want to die. "You're finally going to be happy in heaven", one of the texts read. It is believed that Carter encouraged him so she could get attention and play the grieving girlfriend. "You need to just do it".

Daniel Medwed, a law professor at Northeastern University, said the judge had a hard task in determining whether Carter's actions rose to the level of manslaughter. "You may be seated, that verdict is now recorded and it is in writing as well".

Michelle Carter was miles away when she led Conrad Roy III back into his pickup truck behind a Kmart in Fairhaven.

Top Massachusetts attorneys have mixed opinions about the involuntary manslaughter conviction of Michelle Carter, but they agree on one thing - the ruling has caused a seismic shift in the intersection of technology and the law. "She instructs Roy to get back in the truck knowing of all the feelings he has exchanged with her; his ambiguities, his fears, his concerns", Moniz said.

The trial heard that Carter and Roy exchanged hundreds of text messages in which Carter urged him to follow through on his plan to kill himself, urged him to hide it from his parents, lie to his mother and select a secluded parking lot.

"I thought you wanted to do this".

When Roy insisted that he meant to carry out the act, but wasn't ready, he was met with a barrage of criticism from his girlfriend.

Defense attorney Joseph Cataldo says "we're disappointed" with the guilty verdict.

Carter is expected to be sentenced on August 3 and could face 20 years in prison.

"She is mindful that the process in the truck will take approximately 15 minutes", Mr Moniz said during Friday's hearing.

CNN reports that Carter continued to pepper Roy with text messages while he sat in his vehicle, on the brink of killing himself.

"If you point a gun at somebody, you're pretty much intending to shoot them", Gutterman said.

Carter's lawyers, meanwhile, countered that the messages were protected free speech and that Roy had a history of depression and tried to kill himself during a previous suicide attempt. The state does not have a law against encouraging someone to kill themselves.
